Safety of toys - Part 3: Migration of certain elements

This European Standard specifies requirements and test methods for the migration of aluminium, antimony, arsenic, barium, boron, cadmium, chromium (III), chromium (VI), cobalt, copper, lead, manganese, mercury, nickel, selenium, strontium, tin, organic tin and zinc from toy materials and from parts of toys.
Packaging materials are not considered to be part of the toy unless they have intended play value.
NOTE   See guidance document of the European Commission guidance document no. 12 [2] on the application of the Directive on the safety of toys - packaging.
The standard contains requirements for the migration of certain elements from the following categories of toy materials:
   Category I: Dry, brittle, powder like or pliable materials;
-   Category II: Liquid or sticky materials;
-   Category III: Scraped-off materials.
The requirements of this standard do not apply to toys or parts of toys which, due to their accessibility, function, volume or mass, clearly exclude any hazard due to sucking, licking or swallowing or prolonged skin contact when the toy or part of toy is used as intended or in a foreseeable way, bearing in mind the behaviour of children.
For the purposes of this standard, for the following toys and parts of toys the likelihood of sucking, licking or swallowing toys is considered significant (see H.2 and H.3):
-   All toys intended to be put in the mouth or to the mouth, cosmetics toys and writing instruments categorised as toys may be sucked, licked or swallowed;
-   All the accessible parts and components of toys intended for children up to 6 years of age may come into contact with the mouth. The likelihood of mouth contact with parts of toys intended for older children is not considered significant in most cases (see H.2).

Overview - EN 71-3:2013+A2:2017/prA3 (Toy safety: Migration of elements)

EN 71-3:2013+A2:2017/prA3 is a CEN European standard covering the migration of certain chemical elements from toy materials. It specifies migration limits and test methods for elements such as aluminium, antimony, arsenic, barium, boron, cadmium, chromium (III and VI), cobalt, copper, lead, manganese, mercury, nickel, selenium, strontium, tin, organic tin and zinc. Packaging is excluded unless it has intended play value. The document supports the essential requirements of EU Directive 2009/48/EC and includes migration limit revisions (draft amendment prA3).

Key topics and technical requirements

  • Scope and applicability
    • Applies to migration from toy materials and parts of toys that can be sucked, licked, swallowed or undergo prolonged skin contact when used as intended or foreseeably misused.
    • Excludes toys/parts whose design, accessibility, function, volume or mass clearly rule out such hazards.
  • Material categories for testing
    • Category I: Dry, brittle, powder-like or pliable materials
    • Category II: Liquid or sticky materials
    • Category III: Scraped-off materials
  • Migration limits
    • The standard contains a detailed table of migration limits (mg/kg) per element and per material category. Limits have been updated in the A3 draft (examples include limits for lead, cadmium, barium and chromium(VI)).
  • Test methods
    • Specifies procedures for extracting and measuring migrated elements from toy materials to verify compliance with the migration limits.
  • Regulatory alignment
    • Cross-references Directive 2009/48/EC and subsequent amendments (e.g., limits amended by Commission Regulation (EU) No 681/2013 and Council Directive (EU) 2017/738).

Practical applications and who uses this standard

  • Manufacturers and designers of toys use EN 71-3 to:
    • Select materials and coatings that meet migration limits.
    • Design products intended for children, especially those under 6 years or items likely to be mouthed (teethers, rattles, cosmetics toys, writing instruments).
  • Test laboratories and quality teams apply the specified test methods to certify compliance and prepare technical documentation.
  • Regulatory authorities, market surveillance bodies and importers rely on the standard to assess conformity with EU toy safety rules.
  • Supply chain partners (material suppliers, converters, contract manufacturers) use the limits to control raw materials and components.

Related standards and guidance

  • EN 71 series (other parts) - general toy safety context and mechanical/physical requirements.
  • EU Directive 2009/48/EC - essential requirements for toy safety (standard supports compliance).
  • Commission Regulation (EU) No 681/2013 and Council Directive (EU) 2017/738 - amendments affecting element limits.
