Reporting in support of supervision of online gambling services by the gambling regulatory authorities of the Member States
The development of a European standard(s) on reporting by online gambling service operators and suppliers to the gambling regulatory authorities in the Member States for the purpose of supervision of online gambling services will specify the core data for reporting purposes, while ensuring integrity and security of the data as well as personal data protection.
The requested European standard(s) will provide a voluntary tool to the gambling regulatory authorities in the Member States without prejudice to the scope of competence of Member States in the regulation of online gambling and without imposing any obligation on them to introduce reporting requirements or to authorize or deny authorization to any operators or suppliers.
Berichterstattung zur Unterstützung der Aufsicht über Online-Glücksspiele durch die Glücksspielaufsichtsbehörden der Mitgliedstaaten
Ziel ist die Erarbeitung einer oder mehrerer Europäischer Normen für die Berichterstattung durch Betreiber oder Anbieter von Online-Glücksspielen gegenüber Glücksspielaufsichtsbehörden in den Mitgliedsstaaten zum Zweck der Aufsicht über Online-Glücksspiele (innerhalb der Spezifikation als OGR oder Online-Glücksspiel-Berichterstattung bezeichnet).
Damit wird den Glücksspielaufsichtsbehörden in den Mitgliedsstaaten ein freiwilliges Werkzeug zur Verfügung gestellt, ohne die Amtsbefugnis der Mitgliedsstaaten hinsichtlich der Regulierung von Online-Glücksspielen zu beeinträchtigen. Dieses Werkzeug sieht keinerlei Verpflichtung vor, bestimmte Berichterstattungsvorschriften zu erlassen oder zu verändern oder die Zulassung von Betreibern oder Anbietern zu genehmigen oder abzulehnen, wenn die nationale Gesetzgebung zu Online-Glücksspielen andere Vorschriften vorgibt. Es obliegt weiterhin den Mitgliedsstaaten zu entscheiden, für welche Spiele eine Berichterstattung erfolgen soll. Der Umfang der Berichterstattung entspricht den geltenden Rechtsvorschriften in dem Mitgliedsstaat, in dem der Betreiber lizenziert und in dem Dienste Kunden angeboten werden.

Élaboration d’une ou plusieurs Normes européennes sur les rapports établis par les opérateurs et fournisseurs de services de jeux en ligne à destination des autorités de régulation des jeux en ligne des États membres dans le cadre de la régulation des services de jeux d’argent et de hasard en ligne (l’activité de communication de rapports sur les jeux d’argent et de hasard en ligne étant dénommée OGR [Online Gambling Reporting] dans la spécification).
Cela fournira un outil volontaire aux autorités de régulation des jeux d’argent et de hasard des États membres, sans préjudice de la compétence de ces derniers en matière de réglementation des jeux d’argent et de hasard en ligne. Cela ne leur impose aucune obligation d’introduire ou de modifier les exigences déclaratives ou d’autoriser ou de refuser d’autoriser tout opérateur ou fournisseur, par exemple lorsque la législation nationale sur les jeux d’argent et de hasard impose d’autres règles. Les États membres restent compétents pour définir les jeux pour lesquels il convient de prévoir des déclarations sous forme de rapports. Le périmètre des rapports est conforme à la législation applicable dans l’État membre où l’opérateur est agréé et où les services sont offerts aux consommateurs.
