87/356/EEC - Ranges of nominal quantities and nominal capacities permitted for certain pre-packged products (Dir. 80/232/EEC amendment)
Council Directive 87/356/EEC of 25 June 1987 amends Directive 80/232/EEC to update and harmonize the permitted nominal quantities for certain pre-packaged products within the European Community. The amendment specifically adds knitting yarns to the list of pre-packaged products, specifying allowable nominal quantities ranging from 10 to 1000 grams. This measure aims to remove trade barriers by establishing uniform packaging sizes across Member States, thus creating a more transparent and integrated market. The directive requires Member States to implement the necessary national laws and regulations by 30 June 1988 and to report back to the Commission. The weight values for knitting yarns refer to the anhydrous mass, adjusted for humidity according to Directive 71/307/EEC. This adjustment ensures consistency in measurements across different packaging forms. Overall, the directive furthers the goal of total harmonization in packaging standards to facilitate the free movement of pre-packaged goods within the internal market.
Purpose
The Directive 87/356/EEC aims to amend Directive 80/232/EEC concerning the approximation of the laws of EU Member States related to the ranges of nominal quantities and nominal capacities permitted for certain pre-packaged products. Since the original directive and its subsequent amendment (86/96/EEC), there was a recognized need to expand the scope of regulated nominal quantities to include additional pre-packaged products, specifically knitting yarns. The overall goal is to eliminate barriers to trade within the internal market by ensuring harmonized and transparent regulations concerning packaging sizes and quantities, thus facilitating the free movement and marketing of these products across Member States.
Key obligations
Extension of scope: The Directive extends the application of the original provisions to knitting yarns, including those packaged in different forms from previously regulated packages.
Harmonization of nominal quantities: Pre-packaged knitting yarns covered by the directive may only be marketed in specific nominal quantities enumerated in the directive's Annex I point 11.
Marketing restrictions: After 31 December 1989, Member States may allow the marketing of pre-packaged knitting yarns only in the nominal quantities listed in the Directive.
Implementation and reporting: Member States must adopt and enforce necessary national laws, regulations, and administrative provisions to comply with the Directive by 30 June 1988 and immediately inform the European Commission of measures taken.
Communication of national measures: Member States are required to communicate texts of laws and provisions adopted to comply with the Directive to the Commission.
Affected products and actors
Products: The Directive specifically targets pre-packaged knitting yarns, defined as yarns made of natural (animal, vegetable, mineral), chemical fibers, and their mixtures. Nominal quantities regulated are in grams and include the following values: 10, 25, 50, 100, 150, 200, 250, 300, 350, 400, 450, 500, and 1000 g.
Packaging: The nominal quantities refer to the anhydrous mass of the yarn with a conventional humidity allowance applied according to Directive 71/307/EEC.
Actors: The Directive affects manufacturers, packagers, importers, and distributors of knitting yarns within the European Union, as well as national regulatory authorities responsible for market surveillance and enforcement.
Implementation timeline
Directive adoption: 25 June 1987.
Member States' compliance deadline: All necessary laws and regulations must be in effect by 30 June 1988.
Marketing restriction effective date: As of 31 December 1989, pre-packaged knitting yarn products may only be marketed in the authorized nominal quantities as specified by the Directive.
Reporting: Member States must notify the Commission immediately after adopting compliance measures and periodically communicate the full texts of such measures to ensure transparency and oversight.
This Directive applies to the nominal quantities and nominal capacities permitted for certain pre-packaged products within the European Community. Specifically, it extends the scope of Directive 80/232/EEC to include knitting yarns, consisting of natural fibers (animal, vegetable, and mineral), chemical fibers, and their mixtures, presented in various forms of packaging. The specified nominal quantities for these knitting yarns range from 10 grams up to 1000 grams, considering the anhydrous mass with a conventional humidity allowance. The Directive aims to harmonize the ranges of nominal quantities for these pre-packaged products to remove trade barriers and establish a transparent internal market. The rules apply to pre-packaged knitting yarns marketed within Member States after 31 December 1989.
An EU Directive is a legislative act of the European Union that sets out goals that all EU member states must achieve. However, it is up to each member state to devise their own laws on how to reach these goals through national transposition. Directives are used to harmonize laws across the EU, particularly for the functioning of the single market.
Directive 87/356/EEC covers "Ranges of nominal quantities and nominal capacities permitted for certain pre-packged products (Dir. 80/232/EEC amendment)". There are 318 standards associated with this directive.
Harmonized standards under 87/356/EEC are European standards (ENs) developed by CEN, CENELEC, or ETSI in response to a mandate from the European Commission. When these standards are cited in the Official Journal of the European Union, products manufactured in conformity with them benefit from a presumption of conformity with the essential requirements of 87/356/EEC, facilitating CE marking and free movement within the European Economic Area.
