Zweck
Die Richtlinie 80/232/EWG des Rates vom 15. Wesentliche Verpflichtungen
- Die Richtlinie gilt für Fertigpackungen bestimmter Produkte, die in den Anhängen I bis III gelistet sind, wobei Fertigpackungen, die ausschließlich zum gewerblichen Gebrauch bestimmt sind, ausgeschlossen sind.
- Die Erzeugnisse werden in drei Gruppen eingeteilt:
- a) Nach Gewicht oder Volumen verkaufte Erzeugnisse (Anhang I: Reihen zulässiger Nennfüllmengen).
- b) Nach Gewicht oder Volumen verkaufte Erzeugnisse in formfesten Behältnissen (Anhang II: Reihen der zulässigen Behältnisvolumen).
- c) Aerosole (Anhang III: Volumen der Flüssigphase und Metallbehältervolumen).
- Alle Fertigpackungen müssen mit der Nennfüllmenge (nach Gewicht oder Volumen) gemäß Richtlinie 76/211/EWG gekennzeichnet sein.
- Behältnisse der Produkte gemäß Buchstaben b) und c) müssen zusätzlich eine Angabe ihres Nennvolumens tragen oder einen Hinweis auf die entsprechenden CEN-Normen.
- Bei Sammel- oder Mehrfachpackungen sind die Vorgaben für die einzelnen Teilpackungen oder für die Gesamtpackung entsprechend anzuwenden.
- Mitgliedstaaten dürfen das Inverkehrbringen von Fertigpackungen, die diesen Vorgaben entsprechen, weder verweigern noch einschränken.
- Für zum Zeitpunkt der Bekanntgabe bereits im Verkehr befindliche Fertigpackungen gelten Übergangsregelungen bis zum 1. Januar 1982.
Betroffene Produkte und Akteure
- Die Richtlinie betrifft eine Vielzahl von Produkten, die in Fertigverpackungen zum Verkauf angeboten werden. Die Produkte sind detailliert in den Anhängen aufgeführt, u.a.:
- Lebensmittel verschiedener Art (Butter, Margarine, Frischkäse, Salz, Zucker, Getreideprodukte, Hülsenfrüchte, Kaffeesorten, Tiefkühlprodukte).
- Trockennahrung für Hunde und Katzen.
- Gebrauchsfertige Anstrichfarben und Lacke.
- Klebstoffe in fester oder pulverförmiger Form.
- Pflegemittel für Haushaltsgegenstände, Körperpflegeprodukte sowie Waschmittel und Seifen.
- Lösemittel und Schmieröle.
- Aerosole (mit Ausnahme bestimmter Körperpflegeprodukte und Arzneimittel).
- Akteure sind Hersteller, Abfüller und Händler von Fertigpackungen, die diese Produkte innerhalb der EU in Verkehr bringen.
Umsetzungsfrist
- Die Mitgliedstaaten mussten die notwendigen Maßnahmen zur Umsetzung der Richtlinie innerhalb von 24 Monaten nach ihrer Bekanntgabe erlassen und umsetzen.
- Die Richtlinie wurde am 15. Januar 1980 bekanntgegeben, sodass die Umsetzungsfrist bis spätestens 15. Januar 1982 lief.
- Die Mitgliedstaaten haben die Kommission unverzüglich über die Umsetzung zu informieren und den Wortlaut der wichtigsten nationalen Vorschriften zu übermitteln.
Diese Richtlinie trägt wesentlich zur Vereinheitlichung der Verpackungsvorschriften in der EU bei und fördert den freien Warenverkehr sowie den Schutz der Verbraucher durch klare und transparente Mengenangaben.

- Les gammes fixées s’appliquent aussi bien aux préemballages individuels qu’aux emballages collectifs.
- Les États membres ne peuvent refuser ni interdire ni restreindre la mise sur le marché des préemballages conformes aux prescriptions de la directive en raison des valeurs des quantités ou de la capacité nominale.
Produits et acteurs concernés
La directive s’applique aux produits présentés en préemballages relevant des articles 1er et 2 de la directive 76/211/CEE, à l’exclusion des préemballages destinés exclusivement à un usage professionnel. Ces produits sont répartis en trois groupes :
Produits vendus à la masse ou au volume (excluant ceux des points b) et c)) :
Gammes des valeurs des quantités nominales sont fixées à l’annexe I. Cela inclut notamment :- Produits alimentaires (beurre, fromage frais, sel, sucre, produits à base de céréales, café, surgelés, aliments secs pour animaux),
- Produits de lavage, cosmétiques (produits de beauté et de toilette),
- Peintures, vernis, colles, solvants et huiles de graissage.
Produits vendus en contenants rigides (annexe II) :
Capacité nominale fixée pour conserves, semi-conserves en boîtes métalliques, emballages en verre, aliments humides pour chiens et chats, produits de lavage et nettoyage en poudre.Produits vendus en aérosols (annexe III) :
Volume de la phase liquide et, pour les contenants métalliques, capacité totale du contenant. Exclusion des produits cosmétiques alcoolisés et des médicaments.
Les fabricants, distributeurs et importateurs de ces produits sont concernés par ces règles.
Calendrier de mise en œuvre
- Les États membres avaient un délai de vingt-quatre mois à compter de la notification de la directive pour adopter et mettre en vigueur les mesures nécessaires à sa transposition dans leur droit national.
- Jusqu’au 1er janvier 1982, les États membres ne pouvaient refuser la mise sur le marché de préemballages conformes à la directive 76/211/CEE même si leurs quantités nominales ou capacités des contenants ne respectaient pas encore la directive 80/232/CEE, sous réserve de certaines exceptions pour le Royaume-Uni et l’Irlande.
- Les États membres devaient informer la Commission des mesures adoptées pour se conformer à la directive et communiquer les textes essentiels de leurs dispositions internes.

Direktiva 80/232/EGS ureja usklajevanje zakonodaje držav članic glede nazivnih količin in nazivnih prostornin predpakiranih proizvodov, ki vključujejo živilske izdelke, suho hrano za živali, pripravljene barve, lepila, čistilne in kozmetične proizvode ter topila. Direktiva določa tri skupine proizvodov glede na način prodaje ali pakiranja, pri čemer so za posamezne izdelke določene stopnje nazivnih količin ali prostornin, s čimer se zmanjšujejo ovire za trgovino znotraj Skupnosti. Namen
Direktiva Sveta 80/232/EGS z dne 15. januarja 1980 ureja približevanje zakonodaje držav članic glede stopnje nazivnih količin in nazivnih prostornin, ki so dovoljene za določene predpakirane proizvode. Cilj direktive je olajšati prost pretok teh predpakiranih proizvodov znotraj Evropske skupnosti ter zagotoviti enotne in jasne pogoje za označevanje in predpisane količine, pri čemer se zmanjšajo ovire, ki izhajajo iz različnih nacionalnih meroslovnih predpisov.
Ključne obveznosti
- Določitev stopnje nazivnih količin (mas v gramih ali prostornin v mililitrih) za različne vrste predpakiranih proizvodov v Prilogah I, II in III direktive.
- Oznaka na predpakiranih proizvodih mora vsebovati nazivno maso ali prostornino vsebine v skladu z Direktivo 76/211/EGS.
- Za proizvode, pakirane v togih posodah in za razpršilne proizvode mora biti na posodah označena tudi lastna nazivna prostornina, ki je ne možno zamenjati z oznako vsebine proizvoda.
- Prepoved zavrnitve, prepovedi ali omejitve dajanja v promet predpakiranih proizvodov, ki izpolnjujejo navedene zahteve po količini in prostornini.
- Usklajevanje in poenotenje predpisov držav članic glede dovoljenih prostornin in količin za lažje trgovanje znotraj skupnosti.
- Države članice morajo sprejeti potrebne ukrepe in predpise za uskladitev z direktivo v roku 24 mesecev od njenega notifikacije.
- Komisija mora biti obveščena o sprejetih osnovnih zakonodajnih aktih.
Vplivani produkti in subjekti
- Direktiva zajema izdelke, ki se predpakirajo v skladu s členom 1 in 2 Direktive 76/211/EGS, razen tistih, namenjenih izključno profesionalni uporabi.
- Proizvodi so razdeljeni v tri skupine:

- Proizvajalci, distributerji in prodajalci teh izdelkov morajo spoštovati predpisane definicije nomenklature in količin.
Časovni okvir izvedbe
- Države članice morajo sprejeti ustrezne ukrepe in zakonodajo za uskladitev s to direktivo najpozneje v 24 mesecih po njenem uradnem obveščanju.
- Do 1. januarja 1982 države članice ne smejo zavrniti predpakiranih proizvodov, ki ustrezajo Direktivi 76/211/EGS, čeprav njihova količina ni vključena v novo direktivo, če so bili ti prodani pred njenim začetkom veljavnosti (z izjemo Združenega kraljestva in Irske, ki lahko sprejmeta lastne norme SI enot).
