1 Scope
This Technical Report provides information on the alignment between Directive 2012/19/EU and

EN 50625 series standards and EN 50614 .
2 Normative references
The following documents are referred to in the text in such a way that some or all of their content
constitutes requirements of this document. For dated references, only the edition cited applies. For
undated references, the latest edition of the referenced document (including any amendments) applies.

Commission mandate M/518 requires the production of a number of deliverables to support Directive,
2012/19/EU on Waste Electrical and Electronic Equipment (WEEE). This Directive had to be transposed
into national law in all Member States by February 2014 and so the standards required to support this
legislation had to be developed according to a strict timescale.
Regarding the collection, logistics and treatment of WEEE, Directive 2012/19/EU contains some
requirements to be fulfilled by operators, most of these are not very specific. Mandate M/518 requires that
the deliverables prepared to support Directive 2012/19/EU be ‘state of the art’. Consequently, the
standards and technical specifications prepared under M/518 may contain more detail than the directive.
Mandate M/518 has the following provisions:
‘Article 8(5) of the WEEE Directive requires the Commission to request that the European standardisation
organisations develop European standards for the treatment, including recovery, recycling and preparing
for re-use, of WEEE, reflecting the state of the art. Unlike harmonised standards, the references of which
are published in the Official Journal of European Union, and which are prepared to support Union
harmonisation legislation, these standards do not automatically provide a "presumption of conformity".
However, the Commission may in the future adopt implementing acts laying down minimum quality
standards based in particular on the European standards developed by the European standardisation
organisations.
The European standard(s) requested by this mandate shall assist relevant operators in fulfilling the
requirements of the WEEE Directive. The European standard(s) may also give additional guidance to
operators beyond the level of protection requested strictly by the WEEE Directive. Such additional
guidance should be clearly distinguished from the rest of the text, e.g. figuring as a separate annex or in a

separate deliverable. The standard(s) shall distinguish between requirements which are of an informative
nature, and requirements which should be used by operators in the recycling chain in order to be able to
verify compliance with the requirements in the standard(s)’.
Based upon the above, CLC/TC 111X decided at the outset to not include annexes within each standard,
but instead to create a Technical Report. The European Commission has confirmed that a separate
Technical Report is an acceptable solution to meet the Mandate M/518.
NOTE An Annex ZZ is used in harmonised standards to link the provisions of the harmonised standard to the
Essential Requirements of the New Approach Directive it supports. As per the text shown above from mandate
M/518, this is not applicable to standards supporting the WEEE Directive.

6 Guidance
6.1 Distinction between normative requirements and informative elements in
standardization deliverables
The standard(s) are based on normative treatment requirements derived from the legal text of Directive
2012/19/EC, especially Annex VII. Some normative requirements are based on other existing EU
legislation and regulations.
The text is using normative text and when appropriate additional notes that are informative.
The standardisation deliverables have normative annexes and informative annexes.
The European Standards (EN) and Technical Specifications (TS) establish:

— A normative element; this element describes the scope of the document and/or sets out provisions
(including requirements).
— An informative element; this element is intended to assist the understanding or use of the document
or provides contextual information about its content, background or relationship with other
documents. Notes do not contain instructions, recommendation, permissions, or any information
considered indispensable for the use of the document. Informative annexes may contain optional
requirements.
Normative elements are not used in the following sections and/or elements of the documents:
Introduction; notes; examples; informative annex. The scope is a normative element, but is not a
requirement because it does not give an expression in the content of a document conveying objectively
verifiable criteria to be fulfilled and from which no deviation is permitted if compliance with the document
is to be claimed.
The standardisation deliverables mentioned in Clause 5, covered by M/518, can be the base for audits
that are required by some Member States and/or by Collection Schemes. In order to comply with these
standards an operator is expected to comply with what is stated in the normative text.
A standardisation deliverable does not in itself impose any obligation upon anyone to follow it. However,
an obligation can be imposed, for example, by legislation or by a contract which makes reference to the
document.
In order to be certified according to these standards a company is expected to comply with what is stated
in the normative text.
A more detailed description of informative and normative elements in the standardisation deliverables is
given in CEN/CENELEC Internal Regulations Part 3:2017.
NOTE The Internal Regulations Part 3 from CEN/CENELEC provide information on normative and informative
elements in Clause 3, ‘Terms and definitions’. This clause also defines European Standards (EN) and Technical
Specifications (TS) and Technical Report (TR) documents. The objective of standardization is explained more in
Clause 4.
The standards do have normative annexes and informative annexes.

Article 2 Scope 2.1. This Directive shall apply to electrical and EN 50625-1
electronic equipment (EEE) as follows:

(a) from 13 August 2012 to 14 August 2018

(transitional period), subject to paragraph 3, to EEE

falling within the categories set out in Annex I. Annex

II contains an indicative list of EEE which falls within
the categories set out in Annex I;

4, to all EEE. All EEE shall be classified within the
CLC/TS 50625-3-3
categories set out in Annex III. Annex IV contains a

non-exhaustive list of EEE which falls within the
CLC/TS 50625-3-5
categories set out in Annex III (open scope).

2.2. This Directive shall apply without prejudice to the
requirements of Union legislation on safety and health,
EN 50614
on chemicals, in particular Regulation (EC) No
1907/2006 of the European Parliament and of the
Council of 18 December 2006 concerning the
Registration, Evaluation, Authorisation and Restriction
of Chemicals (REACH), establishing a European
Chemicals Agency (3), as well as of specific Union
waste management or product design legislation.
2.3. This Directive shall not apply to any of the
following EEE:

(a) equipment which is necessary for the protection of
the essential interests of the security of Member
States, including arms, munitions and war material
intended for specifically military purposes;
(b) equipment which is specifically designed and
installed as part of another type of equipment that is
excluded from or does not fall within the scope of this
Directive, which can fulfil its function only if it is part of
that equipment; (c) filament bulbs.
2.4. In addition to the equipment specified in
paragraph 3, from 15 August 2018, this Directive shall
not apply to the following EEE:
(a) equipment designed to be sent into space;
(b) large-scale stationary industrial tools;
(c)large-scale fixed installations, except any
equipment which is not specifically designed and
installed as part of those installations;
(d) means of transport for persons or goods, excluding
electric two-wheel vehicles which are not type-
approved;
(e) non-road mobile machinery made available
exclusively for professional use;
(f) equipment specifically designed solely for the
purposes of research and development that is only
made available on a business-to-business basis;
(g) medical devices and in vitro diagnostic medical
devices, where such devices are expected to be
infective prior to end of life, and active implantable
medical devices.
2.5. No later than 14 August 2015, the Commission
shall review the scope of this Directive set out in point
(b) of paragraph 1, including the parameters to
distinguish between large and small equipment in
Annex III, and shall present a report thereon to the
European Parliament a
